Terms of Use for Kozy

These Terms of Use ("Terms") apply to the Kozy mobile application and the website at usekozy.com (together, the "App"), provided by Tunde Alao ("we," "us," or "our").

By creating an account or using Kozy, you agree to these Terms. If you do not agree, please do not use the App.

1. About Kozy

Kozy is an AI video editor. You upload video, photos and audio, describe the edit you want, and Kozy plans and produces the edit for you. You can reuse editing styles as templates, including templates created from a TikTok or Instagram link you provide, and export the finished video to your photo library.

2. Eligibility and Your Account

You must be at least 16 years old, or the age of digital consent in your country if that is higher, to use Kozy.

You need an account to use Kozy. You can sign in with Apple, Google, or your email address. You are responsible for what happens under your account, so keep your sign-in details to yourself. You can delete your account at any time in the App under Settings → Account Settings.

3. Subscriptions and Credits

3.1 Plans

Kozy's editing features require a paid subscription. Each plan includes a monthly allowance of credits, which are used up when Kozy does AI work for you, such as planning, editing, and creating templates. The plans, their prices, and their credit allowances are shown in the App before you buy.

Credits have no cash value, cannot be transferred, and cannot be exchanged for money.

3.2 Billing

• Subscriptions are billed through Apple's In-App Purchase system to the payment method on your Apple Account.
• Prices are shown in the App before purchase and may vary by region.
• Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current billing period.
• Your Apple Account is charged for renewal within 24 hours before the end of the current period.
• If a free trial is offered, you are charged when it ends unless you cancel before then.

3.3 Managing and Canceling

You can manage or cancel your subscription in the App under Settings, or in your App Store account settings. Deleting the App or your Kozy account does not cancel your subscription.

3.4 Refunds

Purchases are processed by Apple, and refunds are handled by Apple under its refund policies. We cannot issue refunds ourselves.

4. Your Content

You keep ownership of everything you upload to Kozy and of the videos you export from it.

To provide the App, we need to store and process your content, including sending it to the AI and infrastructure providers described in our Privacy Policy. You grant us a worldwide, non-exclusive, royalty-free license to host, copy, process, and modify your content for the sole purpose of operating and improving Kozy for you. This license ends when your content is deleted from our systems.

You are responsible for your content. By uploading it, or by giving us a link to import, you confirm that you have the rights to use it and that it does not break the law or infringe anyone else's rights. This includes any TikTok or Instagram video you import as a template: only import videos you are allowed to use as a reference.

5. AI-Generated Results

Kozy uses artificial intelligence to plan and make edits. AI results can be inaccurate, unexpected, or not what you asked for. Review your video before you publish or share it. You are responsible for how you use what Kozy produces.

While editing, Kozy may add music, images, or other media it finds from third-party sources. That media stays subject to its own license terms, and it is your responsibility to check that you may use it for your purpose, particularly for commercial use.

6. Acceptable Use

You agree not to:

• Use the App for anything unlawful, or to create content that is illegal, sexually exploits minors, harasses or defames others, or infringes someone else's rights
• Upload content you do not have the right to use
• Reverse-engineer, decompile, or extract the source code of the App, except as permitted by law
• Interfere with or disrupt the App or its servers, or access it by automated means outside its intended interface
• Get around any subscription, credit, or payment mechanism
• Resell or share access to your account

7. Intellectual Property

The App, including its design, logos, features, and code, is owned by Tunde Alao and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App in line with these Terms.

8. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that any edit will match your expectations.

Kozy is not a backup service. Keep your own copies of your original footage and of any video you care about.

9. Limitation of Liability

To the maximum extent permitted by law, Tunde Alao is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, content, or profits, arising out of or related to your use of the App.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for gross negligence or willful misconduct, or your statutory consumer rights under EU law.

10. Termination

You may stop using Kozy and delete your account at any time. We may suspend or end your access if you break these Terms.

11. Changes

We may update the App and these Terms from time to time. When we make material changes to the Terms, we will update the "Last updated" date above. Continuing to use the App after changes take effect means you accept the revised Terms.

12. Governing Law

These Terms are governed by the laws of the European Union member state in which Tunde Alao is established, without regard to conflict-of-law principles, and without prejudice to the mandatory consumer protection laws of your country of residence.

13. Apple-Specific Terms

Because Kozy is distributed through the Apple App Store:

• These Terms are between you and Tunde Alao only, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• Apple is not responsible for any product warranties, whether express or implied by law.
• Apple is not responsible for addressing any claims relating to the App or your use of it.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.
